While seafarers are generally protected under the Canada Labour Code R.S.C., 1985, c. L-2, a series of court decisions have held that workers in the fishing industry are subject to provincial occupational health and safety and workers’ compensation law (Mersey, NSCA; Pattison, BCCA; Ryan Estate, SCC).
